1.      The security of user data is the top priority

Félin Fatale respects the privacy of all users of the website or online shop (hereinafter referred to as “the customer” or “customers”). This Privacy Policy forms the basis for the processing of personal data and provides information on what type of user data is collected from customers by Félin Fatale how Félin Fatale uses this data and what rights customers are entitled to. Félin Fatale complies with the applicable data protection laws and processes the personal data solely for the purposes for which the data was transmitted.

These data protection provisions are adapted, supplemented or amended from time to time. With each new call or visit to the website, the current, retrievable version applies.

Should any contradictions arise between this data protection declaration and the otherwise applicable contractual or business terms and conditions of Félin Fatale the provisions of this data protection declaration shall take precedence.

2.      Type and purpose of the data collected

The term “personal data” or “personal information” as used in this Privacy Policy includes information that can be used to personally identify customers.

The processing of personal data refers to any handling of personal data, such as the collection, use, storage, disclosure, transmission or deletion of data.

Félin Fatale collects personal data automatically when the customer interacts with the website or uses the online shop. On the other hand, personal data that a customer provides (e.g. by making contact, creating a user profile or customer account) is collected automatically or manually.

2.1.     Data that is collected automatically

When visiting the Félin Fatale website, statistical visitor data is automatically collected about which parts of the website are visited by the customer. Each time a website is accessed, the web server automatically saves a so-called server log file, which contains, for example, the name of the requested file, the customer’s IP address, the date and time of access, the browser used, the operating system, the amount of data transferred and the requesting provider (access data) and documents the access. In this context, it is sometimes necessary for so-called cookies (cf. section 4 below) are used. 

This access data is analysed exclusively for the purpose of ensuring trouble-free operation of the site and improving our offering.

2.2.     Data, when interacting with Félin Fatale, for contract processing, contacting and opening a customer account

Félin Fatale does not automatically collect personal data from customers, such as their name, address, telephone number or e-mail address.

On the other hand, personal data is collected from customers if a customer provides it voluntarily when placing an order or contacting Félin Fatale (e.g. via contact form or email). Mandatory fields are labelled as such, as Félin Fatale requires the data in these cases to process the contract or to process the contact and the order or contact cannot be sent without this information. Which data is collected can be seen from the respective input forms.

If a customer decides to open a customer account, Félin Fatale will use the personal data for the purpose of opening the customer account. The mandatory information requested during registration must be provided in full, otherwise Félin Fatale may refuse registration. Félin Fatale will only use the personal data collected for the purpose of using the online shop or the respective offer or service for which the customer has registered. In addition, Félin Fatale may use the customer’s e-mail address to inform the customer of important changes, such as changes to the scope of the offer or technically necessary changes.

Data Deletion and Account Termination

After complete fulfilment of the contract or after deletion of the customer account, the customer’s data will be restricted for further processing and deleted after expiry of the retention periods under tax and commercial law, unless the customer has expressly consented to further use of the data or Félin Fatale reserves the right to use data beyond this, which is permitted by law. The deletion of the customer account is possible at any time and can be done either by sending a message to the contact details given below (see section 9 below) or via a function provided for this purpose in the customer account.

The legal basis for the collection and processing of the customer’s personal data depends on the purpose of the data processing in each individual case. The following are possible:

  • safeguarding the legitimate interests of Félin Fatale, provided that the interests of the customer or fundamental rights or freedoms are not unreasonably impaired;
  • the conclusion or fulfilment of a contract; or
  • Consent of the customer at the time the personal data is collected. The customer can withdraw their consent at any time. For this purpose, the customer can send a corresponding message to the contact details described below. The legality of the data processing that has already taken place remains unaffected by the cancellation.

4.      Use of cookies and use of the data

4.1.     Cookies

In order to continuously improve the website for customers, Félin Fatale may use cookies. Cookies are small pieces of software information that are stored on the customer’s computer hard drive by web browsers (e.g. Google Chrome, Internet Explorer or Mozilla Firefox) in order to facilitate the use of the website (e.g. language selection, shopping basket, etc.).

Some of the cookies used by Félin Fatale are deleted again at the end of the browser session, i.e. after closing the web browser (so-called session cookies). Other cookies remain on the end device and enable Félin Fatale to recognise the customer’s web browser on the next visit (persistent cookies). The duration of storage can be found in the overview in the cookie settings of the web browser.

Most web browsers automatically accept such cookies, but web browsers can be configured so that they do not accept or store cookies. If cookies are deactivated, however, the functionality of the website may be restricted. Details on this can be found in the operating instructions or the help function of the web browser.

4.2.     Use of the data

The anonymised data that is recorded using cookies when the Félin Fatale website is accessed can be used for web analysis purposes, to optimise the website and to measure performance. Félin Fatale may use third-party providers for this purpose, some of which have their own data protection regulations over which Félin Fatale has no influence.

Google Analytics     

The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google analyses the use of the website to compile reports on website activity and to provide Félin Fatale with other services relating to website activity and internet usage. The IP address transmitted by the customer’s web browser as part of Google Analytics is not merged with other Google data.

The information generated by cookies about the use of the website is usually transferred to a Google server in the USA and stored there. Google complies with the data protection provisions of the “Swiss-U.S. Privacy Shield” agreement and has registered with the U.S. Department of Commerce for the “Swiss-U.S. Privacy Shield” (information on the Swiss-U.S. Privacy Shield can be found at https://www.privacyshield.gov/Swiss-US-Privacy-Shield-FAQs).

Google Ads and Google Conversion Tracking    

The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

As part of Google Ads, Félin Fatale uses what is known as conversion tracking. If the customer clicks on an advert placed by Google, a cookie is set for conversion tracking. These cookies lose their validity after 30 days at the latest and are not used to identify the customer. If the customer visits  Félin Fatale s website and the cookie has not yet expired, Google and Félin Fatale can recognise that the customer clicked on the ad and was redirected to this page.

Félin Fatale learns from Google the total number of users who clicked on the advert and were redirected to a website with a conversion tracking tag. However, Félin Fatale does not receive any information that can be used to personally identify the customer.

Google Maps
The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Félin Fatale uses Google Maps to visually display geographical information. When Google Maps is used, Google transmits or processes data about the use of the Maps functions by website visitors, which may include in particular the IP address and location data. Félin Fatale has no influence on this data processing.

Insofar as information is transferred to Google servers in the USA and stored there, the American company Google LLC is certified under the “Swiss-U.S. Privacy Shield”.

To deactivate the Google Maps service and thus prevent the transmission of data to Google, a customer must deactivate the Java Script function in the web browser. In this case, Google Maps cannot be used or can only be used to a limited extent.

4.3.     Social media content

Félin Fatale may use social media plugins from social networks such as Facebook, Instagram or Twitter on the website.

When the customer accesses a website that contains such a plugin, the web browser establishes a direct connection to the servers of the respective social network. The respective provider transmits the content of the plugin directly to the web browser and integrates it into the page. By integrating the plugins, the providers learn that the customer’s web browser has accessed Félin Fatale’s website, even if the customer does not have a profile with the corresponding social network or is not currently logged in. The customer’s web browser sends this information (including the IP address) directly to a server of the respective provider (possibly in the USA), where the provider stores it.

If the customer is logged in to one of the services, the providers of the social network can directly assign the visit to the Félin Fatale website to the profile in the respective social network. If the customer interacts with the plugins, for example by clicking the “Like” or “Share” button, the corresponding information is also transmitted directly to a server of the provider and stored there. The information is also published on the social network and displayed there to the customer’s contacts.

These social network platforms have their own data protection regulations, over which Félin Fatale has no influence.

If the customer does not want these plugins to load, they should log out of the relevant social networks. This action helps prevent automatic data sharing with those networks. Various web browsers can be configured or supplemented with add-ons to prevent loading social media plugins. For example, users can install a Facebook blocker.

5.      Newsletter

To receive a newsletter from Félin Fatale, customers must provide their email address and additional information. This ensures verification that the customer owns the email address. Félin Fatale uses a “double opt-in” procedure to confirm consent. If a customer wants to subscribe to the newsletter, they can give consent at registration. Alternatively, they can provide consent later. This can be done via the registration function in the customer account.

With the newsletter, the customer regularly receives recommendations and offers that may be of interest to them. For this purpose, Félin Fatale collects and processes personal data relating to the customer’s usage behaviour on the website, orders placed with Félin Fatale and how the customer uses the newsletter (e.g. whether the newsletter is opened or which web URL links are clicked on). Félin Fatale may analyse this data for statistical purposes in order to better tailor the content of the newsletter to the interests of customers.

Newsletter Subscription and Data Processing

The processing of personal data from the newsletter registration form relies on the customer’s consent. Customers can revoke this consent at any time. They can also cancel via the “Unsubscribe” link in the newsletter. They can also send written notification to Félin Fatale. Alternatively, they can unsubscribe directly through their customer account. Félin Fatale uses the personal data collected to design the content and send the newsletter. It will not be passed on to third parties for their own (advertising) purposes.

Félin Fatale stores the personal data provided by the customer for the purpose of subscribing to the newsletter until the customer unsubscribes from the newsletter.

6.      Forwarding of your data

Félin Fatale will not disclose customers’ personal data to third parties. If the customer consents to data disclosure, Félin Fatale will share the information with non-affiliated companies. Félin Fatale will also comply if the law, an authority, or a court order requires data disclosure. Additionally, if service providers support data processing or website administration, Félin Fatale may involve them. This includes providers for parcel delivery or newsletter dispatch. These third parties must uphold the same level of security and data protection as Félin Fatale. These third parties must maintain the same level of security and data protection as Félin Fatale.

7.      Data security

Unfortunately, the transmission of data via the Internet is not absolutely secure. Félin Fatale works with service providers and Internet providers to protect customers’ personal data. These partners implement appropriate technical and organizational security measures. This ensures the safety of the personal data we handle. However, Félin Fatale cannot guarantee the security of the data transmitted by the customer. Any data transmission is therefore at the customer’s own risk.

8.      Your information and cancellation rights

Customers can inform Félin Fatale at any time, such as by email, if they do not want future contact. They can request that their personal data not be used for future communications. They can also use other methods to withdraw consent, such as through a website feature. Félin Fatale will then ensure that the customer’s data is no longer used for contacting them. They can also cancel participation in special services of the Félin Fatale website, like the newsletter service, at any time.

10.   Final provisions
