The offer on this website is aimed exclusively at consumers residing in Switzerland (hereinafter referred to as “customer”). A consumer is a natural person who maintains business relations with Félin Fatale that cannot be attributed to their commercial or independent professional activity. Orders in non-household quantities may be refused without justification.

Félin Fatale reserves the right to amend these GTCs at any time. The version of these GTCs in force at the time of the order shall apply, which cannot be changed unilaterally for this order. Conflicting or deviating terms and conditions of the customer are not recognized.

3. Prices

The sales prices stated on Félin Fatale are final prices and, unless otherwise stated, include statutory VAT and any other statutory charges such as advance recycling fees (VRG) or copyright fees for electronic devices. Prices are quoted net in Swiss francs (CHF).

Unless otherwise specified, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the order process.

Félin Fatale reserves the right to make technical changes, errors, and misprints, and in particular, to change prices at any time without prior notice. Consulting and support services are not included in the sales prices.

4. Conclusion of contract

The products and prices on this website are non-binding offers.

By placing an order on this website, including accepting these GTCs, the customer submits a legally binding contract offer. Félin Fatale will send an automatic order confirmation by email upon receiving the customer’s offer. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is concluded as soon as Félin Fatale sends a declaration of acceptance by e-mail confirming the shipment of the ordered Félin Fatale products or services.

Orders will only be shipped after full payment has been received (exception: delivery against invoice) and if the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, Félin Fatale is entitled not to accept or only partially accept or fulfill the order. In such a case, Félin Fatale will inform the customer by e-mail. If Félin Fatale has already received the customer’s payment, the payment will be refunded to the customer. If no payment has been made, the customer will be released from the payment obligation.

5. Payment options and retention of title

The customer may use the payment methods indicated in the order process.

Félin Fatale reserves the right to exclude customers from individual payment options without giving reasons or to insist on advance payment.

Félin Fatale may charge default interest of 5% per year and a maximum reminder fee of CHF 20 per reminder if the customer is in default of payment.

The products delivered to the customer remain the property of Félin Fatale until full payment has been made.

6. Delivery, obligation to inspect, notice of defects, and returns

Deliveries will be sent by post or courier service to the address indicated by the customer in the order.

Félin Fatale endeavors to keep delivery times as short as possible. However, any delivery times stated in the order confirmation are non-binding. Félin Fatale may make partial deliveries. In such cases, the customer will incur shipping costs only once.

If delivery against an invoice is offered, the invoice will be sent by e-mail or post at Félin Fatale’s discretion.

If the delivery cannot be delivered or if the customer refuses to accept the delivery, Félin Fatale may terminate the contract after notifying the customer by e-mail and granting a reasonable grace period and may charge the customer for the costs incurred.

The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to notify Félin Fatale immediately in writing by letter or e-mail to the address in the imprint (>Link) of any defects for which Félin Fatale is liable.

Return shipments to Félin Fatale shall be at the customer’s expense and risk. The customer must send the goods in their original packaging, complete with all accessories, together with the delivery bill and a detailed description of the defects, to the return address specified by Félin Fatale in the Legal Notice (>Link).

Suppose Félin Fatale’s inspection reveals that the goods have no detectable defects or that the manufacturer’s warranty does not cover them. In that case, Félin Fatale may charge the customer for the costs of handling, returning, or disposing of the goods.

7. Right of withdrawal

The customer is granted a right of withdrawal for 14 calendar days after receipt of the goods. The deadline is deemed to have been met if the customer sends the written revocation to Félin Fatale by e-mail or letter (address according to imprint, >link) within the deadline. The revocation does not require any justification.

If Félin Fatale exercises the right of withdrawal, the contract will be rescinded. The customer must return the goods within 10 calendar days in their original packaging, complete with all accessories, and together with the delivery bill to the return address specified by Félin Fatale in the legal notice (>Link). Returns to Félin Fatale are at the customer’s expense and risk. Any payment already made will be refunded to the customer within 20 calendar days, provided that Félin Fatale has already received the goods back, or the customer can provide proof of shipment.

Félin Fatale reserves the right to demand reasonable compensation for damage, excessive wear, and tear, or loss of value due to improper handling, to deduct the reduction in value from the purchase price already paid, or to invoice the customer for it.

No right of withdrawal is granted in the following cases:

If the contract has a random element, namely because the price is subject to fluctuations over which the supplier has no control;

If the contract concerns a movable item which, due to its nature, is not suitable for return or may spoil quickly;

When the subject of the contract is a movable item manufactured according to the customer’s specifications or clearly tailored to personal needs.

If the contract involves digital content not on a fixed data carrier, specific conditions apply. Additionally, immediate full fulfillment by both parties must be met.

If the provider is to perform the service in full with the customer’s prior express consent before the withdrawal period has expired, this applies to the subject of the contract.

If the provider undertakes to provide services at a specific time or within a precisely specified period when the contract is concluded, this applies to accommodation, transportation, food and beverage delivery, and leisure activities.

8. Warranty

Félin Fatale endeavors to deliver goods of impeccable quality. If defects are reported on time, Félin Fatale guarantees that purchased goods are defect-free and functional for the statutory warranty period, usually two years from delivery. Félin Fatale may choose to repair, replace, or refund the item. Further warranty rights are not included.

The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects caused by external circumstances. The warranty for consumables and wearing parts (e.g. batteries, accumulators, etc.) is also excluded.

The company does not guarantee the data’s up-to-date, completeness, or correctness. It also does not assure continuous availability or uninterrupted functionality of the website, integrated hyperlinks, or other content. Use of the website may infringe upon third-party rights. Users should be aware that the company cannot ensure the website’s continuous availability or its functionalities at all times. Furthermore, the company cannot guarantee that the data provided on the website is always accurate and complete. It is important to note that the company does not assume responsibility for any interruptions or errors in the website’s operation or the accuracy of its content.

9. Liability

Félin Fatale excludes all liability, regardless of legal basis. Claims for damages against Félin Fatale, its auxiliary persons, or vicarious agents are not covered. It does not cover indirect or consequential damages, profit loss, personal injury, or property damage for the customer. Félin Fatale reserves the right to further mandatory statutory liability, such as gross negligence or unlawful intent.

Félin Fatale uses hyperlinks solely to facilitate the customer’s access to other websites. It cannot know the content of these websites in detail, nor can it assume any liability or other responsibility for them.

10. Data protection

Félin Fatale may process and utilize the data collected during contract conclusion to fulfill obligations arising from the purchase contract and for marketing purposes. Data necessary for service fulfillment may also be shared with contracted service partners, such as logistics partners, or third parties. This ensures smooth service delivery and customer support. It is essential for customers to understand how their data is used and shared for effective service provision.

11. Partial invalidity

Invalid or unenforceable provisions in these GTCs do not affect the validity of the remaining provisions. The other provisions will remain in full force and effect.

12. Further provisions

Félin Fatale expressly reserves the right to amend these GTCs at any time and to put them into effect without prior notice.

In the event of disputes, Swiss substantive law shall apply exclusively, excluding conflict of laws rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

The place of jurisdiction is the place/registered office of Félin Fatale or the consumer’s place of residence.
